These terms cover your use of The Care Card. Please read the parts about your information and our liability carefully.

In short: The Care Card holds information you enter yourself, stored only on your device. It is not medical advice, and because we keep no copy, we cannot recover information that is lost. Keep your own backup.

1. About these terms

These Terms of Service ("Terms") are an agreement between you and The Perception Collective Pty Ltd ("we", "us", "our") for your use of The Care Card app and website. By activating or using The Care Card, you agree to these Terms.

2. What The Care Card is, and is not

The Care Card is a tool that lets you record, carry, and share care and health information that you enter yourself. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. It is not a monitoring or emergency service. Always rely on qualified health professionals and official medical records for medical decisions, and call emergency services in an emergency.

3. Your information is your responsibility

You are responsible for the accuracy of the information you enter, and for how you share it - for example, who you show your QR code or PDF to. Your QR code and PDF contain the information you put in them, so share them only with people you trust.

4. Storage and loss of data - please read

The Care Card stores your information only on your device and inside the QR code, PDF, and backup file that you create. We do not keep a copy, and we cannot see or recover your information.

This means:

  • If your device is lost, damaged, reset, or replaced, if the app is deleted, or if the device clears the app's storage, your information may be lost permanently.
  • We cannot retrieve, restore, or reset information that is lost or becomes inaccessible.
  • You are responsible for keeping your own backup.

Your QR code and PDF carry the essentials and as much else as fits. If you store a lot of information, some of it - such as longer notes and questions - may not fit in the QR code. Your downloadable backup file is the only thing that captures your full record, so download it and keep it somewhere safe.

If you keep more than one person's card in the app, each person has their own card, with its own QR code and its own backup file. Back up each one separately.

To the maximum extent permitted by law, we are not liable for any loss of, damage to, or inability to access your information, however it occurs.

5. Activation codes

Each activation code is for a single, one-time activation. Entering a valid code unlocks The Care Card, and you only need to do this once. To set up your card on a new phone, an additional device, or when moving from the web version to the app, you bring it across with your saved QR code or backup file - you do not need a new code. Activation requires an internet connection; after that, the app works offline. Treat your code, QR code, and backup file like keys to your card, and keep them private.

6. Acceptable use

You agree to use The Care Card only for lawful purposes, and not to misuse it, interfere with its operation, or attempt to bypass or abuse its activation system.

7. Our intellectual property

The Care Card, including its name, design, and software, is owned by us. These Terms do not give you any rights in it beyond using the app as intended.

8. Availability

Once your card is activated, The Care Card runs on your device and does not depend on our servers to work, so you can keep using it offline. We may still release improvements and new features through the App Store and Google Play from time to time, which you can install like any other app update. We aim to keep our website and the one-time activation and purchase services available and working, but, as with any online service, we cannot guarantee they are always available or completely error-free.

9. Australian Consumer Law and our liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.

Subject to those rights, and to the maximum extent the law allows:

  • The Care Card is provided "as is".
  • We are not liable for any indirect or consequential loss, or for any loss of, or inability to access, your information (see section 4).
  • Where we are entitled to limit our liability, our total liability to you for any claim is limited, at our option, to resupplying the relevant service or refunding the amount you paid for it.

Any refund or remedy is subject to you providing valid proof of purchase. As we do not hold a customer database of our own, we rely on your proof of purchase (such as your receipt or order confirmation) to verify a purchase.

10. Changes to these terms

We may update these Terms from time to time. The current version will always be on this page, with the date shown above. Continuing to use The Care Card means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
